STUDENT RESIDENCES – TERMS & CONDITIONS
A. GENERAL
- Only students duly registered in any programme conducted by the institutions under BAC Education Group (hereinafter referred to as BACE), may apply for students’ accommodation.
- In the event the individual ceases to be a student at BACE, he/she is not allowed to utilise the accommodation.
- The Management reserves the right to vary, alter or amend these terms and conditions.
- These Terms and Conditions are to be read in conjunction with other related policies, rules and regulations of Hostels Asia Sdn Bhd and BACE, where relevant.
- Students are expected to have read and understood all the terms of the Hostels Asia’s Privacy Policy Notice. The onus and responsibility will be on the part of the visitors/students and/or users to read, check and understand the terms of the said Privacy Policy. By accessing or using the Hostels Asia website, you agree to the contents of the said Privacy Policy.
B. RESERVATION, PAYMENT & ACCOMODATION
- The requisite application form must be completed accurately to facilitate processing and applicants (“student”) are required to pay full amount as Reservation Fee.
- Room reservations are not transferable.
- Upon confirmation on the availability of rooms, students are required to pay the rental due for THREE (3) MONTHS in advance and the Reservation Fee shall be held as Hostels Deposit (hereinafter referred to as “Deposit”). In the event there is unavailability of rooms, the Reservation Fee will be returned less any administrative charges.
- All students are required to sign a tenancy agreement for a minimum period of THREE (3) MONTHS.
- Payments of room rental are to be made quarterly OR (1) year in advance.
- Quarterly payments must be made by the 3rd of the first month of each new quarter for the Management to allow continued occupation of the room.
- All other charges including utility (exceeding the allowable maximum), transport and other charges incurred by the student shall become due and payable monthly and must be settled within 14 days from the date the bill is presented for payment.
- Each student will be provided with a copy of an inventory of the bedroom and communal area upon arrival at the residence. Students should check and sign the inventory list for furnishings, fittings and equipment for the student’s room and communal areas of the residence as appropriate. If the Management fails to provide a student with an inventory list the onus is on the student to request for the list and to check and record all damage and missing items within 48 hours of arrival. If the inventory list is not signed and returned within 48 hours then the Management will assume that everything is in good order and that the contents of the residence is undamaged and complete. If there is any subsequent loss or damage to the residence during the term of the tenancy, the student will then be requested to pay for the damage or missing items either solely for the student’s own room and/or jointly with other students for the communal areas.
- Once the student has moved in to the assigned room, changing of rooms will not be allowed.
- The tenancy is valid only for the duration pre-paid for. The Management reserves the right to renew or not to renew the student’s tenancy.
C. TERMINATION
- Formal / written notice of ONE (1) month must be given via email at accommodation@bac.edu.my by the student to the Management.
- In the event that formal notice is not given to the Management and the keys and Student Residence ID is not returned, the tenancy will be taken to be still active.
- Any materials / personal belongings of the student which is not cleared / removed from the accommodation after termination / expiry of the tenancy will be cleared by the Management without any prior notice.
- The tenancy may be terminated by the Management in the event:-
- The student fails to pay the rental amount on the prescribed date;
- The student fails to comply with the rules and regulations for accommodation;
- The accommodation building / complex undergoes renovation / repairs; and
- Any other reason deemed appropriate by the Management.
- Hostels Asia Sdn Bhd, BACE or its subsidiaries, affiliates or authorised representatives shall not be held liable for any losses or damages that may occur, including during the cleaning after the tenancy is terminated / expired.
- If there is no proper handover, the Management may recover possession of the accommodation by giving notice in writing to the student’s last known address and all cost incurred in the recovery of possession including legal costs thereby shall be borne by the student.
